Our client is a multi billion dollar business in the Infrastructure space. They are looking for a Senior Litigation Counsel to join their dynamic and highly regarded legal team to work on a range of Commercial Disputes and Regulatory Investigations including : Construction, Environment, Employment & Safety matters.

 The role will involve hands on Project Management of big ticket litigation work - using a panel of external law firms, but also developing and managing litigation strategy. 

On major disputes, particularly those involving reputational matters, you may work alongside the General Counsel & Company Secretary. You will also interact with senior executives across the business, as required.

This role will also provide the opportunity to work autonomously across a range of smaller matters. 

Key Accountabilities

  • Managing and advising on disputes arising out of construction matters, commercial transactions and WHS matters. In addition to developing strategies, this will involve managing relationships with witnesses and other internal stakeholders, co-ordinating document production and providing advice on generic dispute/evidentiary issues, such as legal professional privilege;

  • Managing regulatory investigations;

  • Successfully managing external counsel;

  • Providing commercial and regulatory advice specific to the industry, including regulatory changes and corporate governance issues; and

  • Working with, and providing training for, various internal stakeholders, including procurement, operations and health and safety teams.

 

Essential:

  • 6 -10+ years post qualification experience in commercial or regulatory litigation/disputes

  • Commercial awareness and the ability to work effectively with internal clients;

  • Excellent negotiating and influencing skills and the proven ability to manage competing priorities across a diverse portfolio of matters;

  • Superior analytical and drafting skills with good risk awareness;

  • Ability to communicate complex legal and compliance-related concepts to a broad range of technical and non-technical staff; and

  • Ability to maintain confidentiality of highly sensitive information, use discretion and make sound decisions.

Desirable:

  • Australian based experience and knowledge of commercial construction contracting;

  • Work Health and Safety Act (or equivalent legislation in other jurisdictions) and similar regulatory experience;

  • Real estate dispute experience (for example, lease revaluations, compulsory acquisition, land access rights).
